End User License Agreement
Acceptance, installation and/or use of the Software by the User constitutes acceptance of the terms and conditions of this License.
Copyright © 2020 Peltier Technical Services, Inc. All rights reserved. The Software is owned by Peltier Technical Services, Inc., and is protected by United States copyright laws and international treaty provisions.
Scope of License. The software is licensed, not sold. This agreement only gives you some rights to use the Software. Peltier Technical Services reserves all other rights. Unless applicable law gives you more rights despite this limitation, you may use the software only as expressly permitted in this agreement. In doing so, you must comply with any technical limitations in the software that only allow you to use it in certain ways.
Grant of license. This software license agreement (“license”) permits you to use one copy of the Software, on one computer. If you are the primary user of two computers (e.g., a desktop in your office and a laptop for traveling, or a work computer and a home computer), you may install the Software on both of these computers. You may either (a) make one copy of the Software solely for back up or archival purposes, or (b) transfer the Software to a single hard disk provided you keep the original solely for back up or archival purposes.
Limitations on reverse engineering, decompilation, and disassembly. You may not reverse engineer, decompile, or disassemble the software, except and only to the extent that such activity is expressly permitted by applicable law.
Disclaimer of Warranty. The Software is licensed “as-is.” The User bears the entire risk as to the quality and performance of the software. Peltier Technical Services gives no express or implied warranties, guarantees or conditions. You may have additional consumer rights under your local laws which this agreement cannot change. To the extent permitted under your local laws, Peltier Technical Services disclaims the implied warranties of merchantability, fitness for a particular purpose and non-infringement. This limited warranty gives you specific legal rights. You may have others which vary from state/jurisdiction to state/jurisdiction.
Customer remedies. Peltier Technical Services’ entire liability and your exclusive remedy shall be, at Peltier Technical Services option, either (a) return of the price paid, or (b) replacement of the Software. This limited warranty is void if failure of the Software has resulted from accident, abuse, or misapplication.
Limitation of liability. To the maximum extent permitted by applicable law, in no event shall Peltier Technical Services be liable for any special, incidental, indirect, or consequential damages whatsoever (including, without limitation, damages for loss of business profits, business interruption, loss of business information, or any other pecuniary loss) arising out of or in connection with the acquisition, installation or use, or attempted installation or use, of the Software, including, without restricting the generality of the foregoing, any loss or damage, direct or consequential, caused in whole or in part by any real or alleged failure of or defect in the Software, even if Peltier Technical Services has been advised of the possibility of such damages. Because some states/jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, the above limitation may not apply to you.
